The Analysis on Use Right Transfer of Rural Collective Construction Land from the View of Farmers’ Property Rights Protection

摘要： 目前，农村集体建设用地使用权流转中农民权益存在流失已成为不争的事实。文章对我国农村集体建设用地使用权流转中农民权益流失进行反思，指出流失的根源在于制度安排的缺陷，制度完善是实现和保护农民土地权益的根本路径，并强调制度完善的关键在于建立包括产权、市场、管理和法律等在内的完整制度体系。

Abstract: It has been an indisputable fact that farmers’ property rights lose a lot during the process of rural collective construction land transfer right now. Root of losing is the defects of institution arrangement, thus improving institution arrangement is the basic way to realize and protect farmers’ land property rights. The key to institutional reform is establishing a complete institution system which includes institution of property rights, market, management, legislation and so on.
