中国食品安全管理中监管模式探究

摘要: 在食品安全监管的诸多问题中,监管主体及其模式的设置占有重要地位。文章通过对中国食品安全管理中存在问题的简单回顾,总结了国内食品安全管理的监管模式和立法现状,发现食品安全管理在体系设置、监管及责任追究模式、执法人员素质等方面存在问题,并在此基础上,笔者从分析中国食品安全监管现状出发,以公共执法和私人执法二元结合的角度,提出了完善公共执法体系、加强私人执法模式的探讨、建设公共执法与私人执法的信息沟通机制、公共执法和私人执法合理分工等加强食品安全管理的具体对策。

Abstract: For a long time, food safety problem has been plagued by all countries in the world, and in recent years have become increasingly prominent trend. In view of this, people pay more attention to the management of food safety, but also more abundant discussion in academic circles. Public law enforcement level, but Chinese scholars focus more on food safety management, and the study of public enforcement and private enforcement of combining the two less. In this paper, starting from the analysis of food safety supervision in our country and the public enforcement and private enforcement, from two yuan with angle, discusses how to promote the effective countermeasures of food safety management.
